The philosophy of Epicurus (c. 341-271 B. C. E.), has been a quietly pervasive influence for more than two millennia. At present, when many long revered ideologies are proven empty, Epicureanism is powerfully and refreshingly relevant, offering a straightforward way of dealing with the issues of life and death. The chapters in this book provide a kaleidoscope of contemporary opinions about Epicurus' teachings. They tell us also about the archeological discoveries that promise to augment the scant remains we have of (...) Epicurus's own writing. the breadth of this new work will be welcomed by those who value Epicurean philosophy as a scholarly and personal resource for contemporary life. Objectives: Bronchoalveolar lavage obtained at bronchoscopy is useful for research on pulmonary defence mechanisms. Bronchoscopy involves some discomfort and risk to subjects. We audited the process of consent, experienced adverse effects and reasons for participation among research bronchoscopy volunteers.Design: 100 consecutive volunteer research subjects attending for bronchoscopy, repeat bronchoscopy or routine recruitment clinic were interviewed. Information was gathered about volunteer motivation, perception of the consent process and adverse effects of bronchoscopy. Suggestions for improvement were requested. Responses were themed by a (...) second investigator prior to data analysis.Results: 81 bronchoscopy-experienced subjects and 19 new volunteers were interviewed. 19 subjects reported adverse symptoms during or after bronchoscopy, but no symptoms were of sufficient severity that they would not repeat the procedure. The frequency of symptoms was not related to gender, the quality of the lavage or the HIV status of the subject. 76 subjects reported that the information given pre-procedure was useful and adequate but 43 had further questions mostly relating to their own results. The reasons given for research participation were access to health assessment , access to treatment when ill , desire to participate in research and remuneration . 7 subjects complained that the remuneration was inadequate.Conclusions: The main incentive to participation in research bronchoscopy was access to healthcare. Informed consent and procedure technique were adequate but subjects would value more feedback about individual and project results. (shrink)

The Patient Self Determination Act of 1991 brought much needed attention to the importance of advance care planning and surrogate decision-making. The purpose of this law is to ensure that a patient’s preferences for medical care are recognized and promoted, even if the patient loses decision-making capacity. In general, patients are presumed to have DMC. A patient’s DMC may come under question when distortions in thinking and understanding due to illness, delirium, depression or other psychiatric symptoms are identified or suspected. (...) Physicians and other healthcare professionals working in hospital settings where medical illness is frequently comorbid with depression, adjustment disorders, demoralization and suicidal ideation, can expect to encounter ethical tension when medically sick patients who are also depressed or suicidal request do not resuscitate orders. In general, Confucians have taken a dim view of the law. They have felt warranted in this view by a reading of Confucius’ Analects 2.3 in which the Master apparently disparages law-centered governance. Two great Confucian philosophers, however, Zhu Xi and Jeong Yakyong (widely known by his pen name, Dasan), view the role of law in society differently. Like all Confucians, they teach the cultivation of virtue, but alongside building social harmony through ritual and good character, these two philosophers perceive (...) that social order also requires the penal law. In this paper, I argue that Zhu Xi and Dasan, and Dasan in particular, follow the evidentiary lead of the classical Chinese philosopher Mozi to support their legal philosophy. Mozi offered three standards for establishing truth claims: empirical evidence from common life, authoritative evidence, and evidence of outcomes. Mozi’s empirical standard takes evidence of common life from what ordinary people have seen. Zhu Xi and Dasan take the evidence of common life, not from what the people have seen, but from common understandings contained in the written language. They use this approach to arrive at a different understanding of Analects 2.3 than other Confucians, one that relates the content of that passage to Analects 12.17. They interpret the passage on a philological basis that supports the presence of penal law from a perspective of ordinary life. For authoritative evidence, Zhu Xi and Dasan like Mozi appeal to the authority of the ancient sages, who register their support for penal law. Dasan also follows Mozi’s evidentiary lead in the evidence of outcomes by fully developing a consequential picture of how the absence of law detrimentally affects society. On this point, Dasan establishes a new and revolutionary legal outlook that differs from that of Zhu Xi. I show Dasan taking lessons from the classical Legalists to arrive at this position warranted by the evidence of outcomes. Having satisfied the three evidentiary standards, Dasan thus establishes the importance of the penal law from a Confucian perspective. (shrink)

ABSTRACTHan Fei’s political theory is widely characterized as eschewing any connection with morality; so, can he have any conception of justice? In this paper, I accept the interpretation of Han Fei jettisoning any moral commitment, but I argue that he gives heed to an understanding of justice. This conception of justice arises naturally from the ordinary human sentiment of resentment for wrongs done and becomes a moral staple in the consciousness of ordinary people. Such a conception of justice has these (...) features: all and only the guilty receive punishment, and the punishments are in some sense proportionate to the crime. Since disregarding this popular conception of justice results in resentment and political instability, Han Fei, without any moral commitment to it, accepts the popular conception of justice on prudential and consequentialist grounds. The classical Chinese philosopher Mengzi shares the idea with David Hume that virtue and vice are dispositions of character that arise from original qualities of the mind. Mengzi is guardedly optimistic that these original qualities can be extended to become fully formed virtues, while Hume is guardedly skeptical about this same enterprise. Yet these two thinkers have something to share with each other. In this essay I will use illustrations from Mengzi to sketch out an interpretation of extending original moral (...) qualities into the virtue of benevolence. I will chart two developmental stages on the pathway to fully developed benevolence, and I will attempt to superimpose Hume’s account of the passions and his double.. (shrink)

Epictetus was born a slave. His master, Epaphroditus, allowed him to attend the lectures of the Stoic philosopher Musonius Rufus and later gave him his freedom. From numerous references in his Discourses it is clear that Epictetus valued freedom as a precious possession. He would have been on the side of the many people living now who, while not actually enslaved, are denied true freedom by the harsh circumstances of their lives. Epictetus's teachings about freedom and human dignity have echoed (...) through the millennia-in the writings of Spinoza, Thomas Paine and Martin Luther King, Jr., to name a few. He was much concerned with human behavior. His advice to not worry about what is not in our control is pointedly relevant to our busy modern society-which is often fraught with anxiety. Some people might argue that what Epictetus taught is not serious philosophy, more like self-help. But the range of topics addressed by the essays in this book clearly indicates that the teachings of Epictetus provide strong incentive to present day philosophical thinking. Children learn and use various strategies to solve math problems. One way children's math learning can be supported is through their use of and exposure to hand gestures. Children's self-produced gestures can reveal unique, math-relevant knowledge that is not contained in their speech. Additionally, these gestures can assist with their math learning and problem solving by supporting their cognitive processes, such as executive function. The gestures that children observe during math instructions are also linked to supporting cognition. Specifically, children are (...) better able to learn, retain, and generalize knowledge about math when that information is presented within the gestures that accompany an instructor's speech. To date, no conceptual model provides an outline regarding how these gestures and the math environment are connected, nor how they may interact with children's underlying cognitive capacities such as their executive function. In this review, we propose a new model based on an integration of the information processing approach and theory of embodied cognition. We provide an in-depth review of the related literature and consider how prior research aligns with each link within the proposed model. Finally, we discuss the utility of the proposed model as it pertains to future research endeavors. (shrink)

This essay examines Hume’s attitude to suicide, in which he had an ongoing philosophical interest, as found in the dialogue at the end of An Enquiry concerning the Principles of Morals, and in his brief essay on the topic. His attitude to, arguments, and views on suicide are placed in the context of his other writings and biographical elements from his own life. The views of other early modern thinkers to suicide, Locke, Kant, and Montaigne, are presented and their arguments (...) evaluated for contrast and comparison with Hume’s views. The views of other writers, most notably the Stoics and St. Thomas Aquinas, are also examined to further elucidate Hume’s views. By carefully reconstructing and evaluating his argument, Hume’s line of reasoning on suicide is found to be out of harmony with his general moral philosophy. The major weakness of his argument is identified as the failure to realize the harm caused to others by suicide. (shrink)

The liberal perspective entrusts to civic education the roles of combating declining numbers in national public participation and of closing the civic empowerment gap between privileged and under-privileged groups. Citizens equipped with rationality, on this view, will be able to see that participating in the public arena is a benefit to themselves and to the country. This paper critically examines this position, and finds that liberal forms of education suffer from three failings. First, people’s rationality is more likely to persuade (...) them that public participation is too costly in comparison with the advantages found in private life. Second, cognitive states developed in learning-based education may not provide sufficient motivation for action. Third, the liberal take on education may have exaggerated people’s capacity for making rational choices. These three failings come together to suggest that liberal style civic education is unlikely to increase public participation or diminish the civic empowerment gap. (shrink)

The US neutrino community gathered at the Workshop on the Intermediate Neutrino Program at Brookhaven National Laboratory February 4-6, 2015 to explore opportunities in neutrino physics over the next five to ten years. Scientists from particle, astroparticle and nuclear physics participated in the workshop. The workshop examined promising opportunities for neutrino physics in the intermediate term, including possible new small to mid-scale experiments, US contributions to large experiments, upgrades to existing experiments, R&D plans and theory. The workshop was organized into (...) two sets of parallel working group sessions, divided by physics topics and technology. Physics working groups covered topics on Sterile Neutrinos, Neutrino Mixing, Neutrino Interactions, Neutrino Properties and Astrophysical Neutrinos. Technology sessions were organized into Theory, Short-Baseline Accelerator Neutrinos, Reactor Neutrinos, Detector R&D and Source, Cyclotron and Meson Decay at Rest sessions.This report summarizes discussion and conclusions from the workshop. In this empirical paper, Jay, Stone, Meksin, Merck, Gordon and Hirst examine whether jury deliberations, in which individuals collaboratively recall and discuss evidence of a trial, shape the jurors’ memories. In doing so, Jay and colleagues provide a highly ecologically valid baseline for future investigation into why, how and when selective recall either facilitates remembering or leads to forgetting during jury deliberations. In particular, Jay et al. explore the specific social and cognitive mechanisms that might lead to either memory (...) facilitation (RIFA – Retrieval Induced Facilitation) and forgetting (RIF ‐ Retrieval Induced Forgetting) during jury deliberation. Macphail’s comparative approach to intelligence focused on associative processes, an orientation inconsistent with more multifaceted lay and scientific understandings of the term. His ultimate emphasis on associative processes indicated few differences in intelligence among vertebrates. We explore options more attuned to common definitions by considering intelligence in terms of richness of representations of the world, the interconnectivity of those representations, the ability to flexibly change those connections, knowledge, and individual differences. We focus on marine mammals, represented by the amphibious pinnipeds (...) and the aquatic cetaceans and sirenians, as animals that transitioned from a terrestrial existence to an aquatic one, experiencing major changes in ecological pressures. They adapted with morphological transformations related to streamlining the body, physiological changes in respiration and thermoregulation, and sensory/perceptual changes, including echolocation capabilities and diminished olfaction in many cetaceans, both in-air and underwater visual focus, and enhanced senses of touch in pinnipeds and sirenians. Having a terrestrial foundation on which aquatic capacities were overlaid likely affected their cognitive abilities. Vocal and behavioral observational learning capabilities in the wild and in laboratory experiments suggest versatility in group coordination. Empirical reports on aspects of intelligent behavior like problem-solving, spatial learning, and concept learning by various species of cetaceans and pinnipeds, suggest rich cognitive abilities. The high energy demands of the brain suggest brain-intelligence relationships might be fruitful areas for the study when specific hypotheses are considered, e.g., brain mapping indicates hypertrophy of specific sensory areas in marine mammals. Modern neuroimaging techniques provide ways to study neural connectivity, and the patterns of connections between sensory, motor, and other cortical regions provide a biological framework for exploring how animals represent and flexibly use information in navigating and learning about their environment. At this stage of marine mammal research, it would still be prudent to follow Macphail’s caution that it is premature to make strong comparative statements without more empirical evidence, but an approach that includes learning more about how animals flexibly link information across multiple representations could be a productive way of comparing species by allowing them to use their specific strengths within comparative tasks. An examination of tool marks and other evidence of manufacturing techniques on two astrolabes of identical pattern made by Hartman of Nuremberg in 1537 shows that all of the parts have been laid out with scribers and filed to final dimensions. All parts except the rings of the maters, which are castings, are made of sheet brass. The only machine tool employed was a small lathe with longitudinal feed, which was used to turn the diameters of the pins. Corresponding dimensions (...) of the two astrolabes differ by less than 0·2 mm on average, but parts are not interchangeable between the instruments. There is evidence that this pattern of astrolabe was made in batches with division of labour in Harman's shop. This paper is an introductory study intended to show methods of examination that reveal manufacturing techniques. (shrink)

Early in this century, only a few biologists accepted that natural selection was the chief cause of evolution, until the independent calculations of John Burdon Sanderson Haldane (1892–1964), Sewall Wright and R. A. Fisher demonstrated that ideal populations subject to Mendel's laws could behave as Darwin had said they would. Evolutionary theorist John Maynard Smith, a student of Haldane's, has raised the question of why Haldane, who was no naturalist, took up the subject of evolution, and he suggests that the (...) answer may have to do with Haldane's lively interest in religion. Purpose: Gordon Pask has left behind a voluminous scientific oeuvre in which he frequently uses technical language and a detail of argument that makes his work difficult to access except by the most dedicated of students. His ideas have also evolved over a long period. This paper provides introductions to three of Pask's key concepts: "conversations," "individuals," and "concepts." Method: Based on the author's close knowledge of Pask's work, as his collaborator for ten years and as someone who has (...) had access to and is familiar with almost all of his published work, the paper selects three of Pask's key concepts for elucidation in order to motivate the interested reader to explore Pask's work in the original. Results: Pask's key concepts, "conversations," "individuals," and "concepts," which are central in his conversation theory and his later elaborations in "interaction of actors theory," are shown to be grounded in fundamental principles from cybernetics. Furthermore, the form of Pask's theorising is that of second order (reflexive) metatheorising, developing theories of theorising that explain their own form and genesis. (shrink)

The purpose of this paper is to provide an account of the epistemology and metaphysics of universe creation on a computer. The paper begins with F.J.Tipler's argument that our experience is indistinguishable from the experience of someone embedded in a perfect computer simulation of our own universe, hence we cannot know whether or not we are part of such a computer program ourselves. Tipler's argument is treated as a special case of epistemological scepticism, in a similar vein to `brain-in-a-vat' arguments. (...) It is argued that the hypothesis that our universe is a program running on a digital computer in another universe generates empirical predictions, and is therefore a falsifiable hypothesis. The computer program hypothesis is also treated as a hypothesis about what exists beyond the physical world, and is compared with Kant's metaphysics of noumena. It is proposed that a theory about what exists beyond the physical world should be formulated with the precise concepts of mathematics, and should generate physical predictions. It is argued that if our universe is a program running on a digital computer, then our universe must have compact spatial topology, and the possibilities of observationally testing this prediction are considered. The possibility of testing the computer program hypothesis with the value of the density parameter Omega_0 is also analysed. The informational requirements for a computer to represent a universeexactly and completely are considered. Consequent doubt is thrown upon Tipler's claim that if a hierarchy of computer universes exists, we would not be able to know which `level of implementation' our universe exists at. It is then argued that a digital computer simulation of a universe cannot exist as a universe. However, the paper concludes with the acknowledgement that an analog computer simulation can be objectively related to the thing it represents, hence an analog computer simulation of a universe could, in principle, exist as a universe. The question of nationalism as spoken about in contem porary circles is structurally the same as Marx's 'Jewish Question'. Through a reading of Marx's early writings, particularly the 'Jewish Question' essay, guided by Derrida's Specters of Marx and Benedict Anderson's Imagined Communities, it is possible to begin to rethink the nationalist question. In this light, nationalism emerges as the byproduct of the reduction of heterogeneous 'people' into a homo geneous 'state'; such 'excessive' voices occupy an ontological space outside of the (...) categories within which the state operates, and thus return, in Derrida's terms, to 'haunt' it. In this paper I critically examine recent developments in intellectual property law. In particular, from a point of view informed primarily by Marx and Foucault, I study (a) the rhetoric surrounding the Metallica lawsuit against Napster; (b) a pair of conflicting trademark cases surrounding the ownership of a word on the Internet; and (c) the software industry's move to win approval for “shrink-wrap” or “click here” licenses. I conclude that these developments indicate a new form of disciplinary power, where people (...) are individuated ex ante as consumers. Despite the celebrations of market cyberlibertarians, this move actually masks an increase in overt state power as the state apparatus is invoked to force individuals to agree to behave as disciplined consumers and accede to the system in the first place. The Bayesian approach to quantum mechanics of Caves, Fuchs and Schack is presented. Its conjunction of realism about physics along with anti-realism about much of the structure of quantum theory is elaborated; and the position defended from common objections: that it is solipsist; that it is too instrumentalist; that it cannot deal with Wigner's friend scenarios. Three more substantive problems are raised: Can a reasonable ontology be found for the approach? Can it account for explanation in quantum theory? Are subjective (...) probabilities on their own adequate in the quantum domain? The first question is answered in the affirmative, drawing on elements from Nancy Cartwright's philosophy of science. The second two are not: it is argued that these present outstanding difficulties for the project. A quantum Bayesian version of Moore's paradox is developed to illustrate difficulties with the subjectivist account of pure state assignments. (shrink)

This reading will be implemented to reconcile a well-known quarrel between two important interpreters of Duns Scotus, Allan B. The relationship of consciousness to brain, which Schopenhauer grandly referred to as the "world knot," remains an unsolved problem within both philosophy and science. The central focus in what follows is the relevance of science---from psychoanalysis to neurophysiology and quantum physics-to the mind-brain puzzle. Many would argue that we have advanced little since the age of the Greek philosophers, and that the extraordinary accumulation of neuroscientific knowledge in this century has helped not at all. Increas- ingly, philosophers and scientists have (...) tended to go their separate ways in considering the issues, since they tend to differ in the questions that they ask, the data and ideas which are provided for consideration, their methods for answering these questions, and criteria for judging the acceptability of an answer. But it is our conviction that philosophers and scientists can usefully interchange, at least to the extent that they provide co~straints upon each other’s preferred strategies, and it may prove possible for more substantive progress to be made. Philosophers have said some rather naive things by ignoring the extraordinary advances in the neurosciences in the twentieth century. The skull is not filled with green cheese! On the other hand, the arrogance of many scientists toward philosophy and their faith in the scientific method is equally naive. The main theme of these lectures is man's struggle to understand himself as a social being. A discussion of the major problems confronting man in his attempts to come to grips with the modern social world ends with a plea for liberalism and rationalism as the political and intellectual foundations of freedom and progress.

A simple random walk model has been shown by Gaveauet al. to give rise to the Klein-Gordon equation under analytic continuation. This absolutely most probable path implies that the components of the Dirac wave function have a common phase; the influence of spin on the motion is neglected. There is a nonclassical path of relative maximum likelihood which satisfies the constraint that the probability density coincide with the quantum mechanical definition. In three space dimensions, and in the presence of (...) electromagnetic interaction, the Lagrangian for this optimal, nonclassical path coincides with the Lagrangian of the Dirac particle. The nonrelativistic, or diffusion, limit is shown to be a formal consequence of Einstein's dynamical equilibrium condition; the continuity equation reduces to the same diffusion equation derived from Schrödinger's equation. The relativistic, massless limit, which would describe a neutrino, is comparable (in the sense of analytic continuation) to a nonviscous liquid whose molecules possess internal degrees of freedom.
